("we"), as well as the terms and conditions governing your use of the
website www.lemanspadel.ge and the execution of online bookings. When
registering an account on our website, an electronic document containing
the terms and conditions effective at the time of registration will be
sent to your email address. We recommend that you print and save a copy
of these terms and conditions for future reference. Please carefully
read the company's current terms and conditions before making any
bookings on the website www.lemanspadel.ge. Please note that these terms
and conditions may be changed unilaterally by the company without prior
notice. You may receive notifications regarding significant changes to
the terms and conditions via your registered email address. The updated
version of the terms and conditions will always be available on the
website. When making a booking, the version of the terms and conditions
available on www.lemanspadel.ge at the time of the booking will apply,
except in cases where changes are required by law or government
authorities, and we may be mandated to apply such changes to your
previously made bookings. By accessing and using the electronic platform
and placing bookings, you confirm that you have read and understood the
terms and conditions and agree to be bound by the obligations
stipulated therein. For ease of reference, these terms and conditions
are conditionally divided into two chapters: (i) General terms and
conditions for the use of the electronic platform, and (ii) Terms and
conditions for making bookings through the electronic platform.
Chapter 1 – Terms and Conditions for the Use of the Electronic Platform
Definitions
In these terms and conditions, certain terms used by us are defined as follows:
1.1. Account
– The closed/confidential part of the electronic platform and the
application, which the user accesses using an email address and
password. The account is used by the user to place bookings. The account
contains various information about the user and their activity on the
website, provided by the user (personal data) or automatically by the
website (booking history, etc.).
1.2. Services indicated in clause 3.1.
1.3. Electronic Platform – Our website and/or application.
1.4. Website – Our website with the domain www.lemanspadel.ge, through which the service indicated in clause 3.1 is available.
1.5. Company
– "Lemans Padel" LLC (I/D 404775383), founded in Georgia and operating
in accordance with the legislation of Georgia. The company may also be
referred to as "we" or "our".
1.6. Service
– The service offered by our company through the electronic platform,
which implies the provision of an online booking service for the use of
padel courts and the equipment necessary for playing.
1.7. User
– Any natural person aged 18 or older who registers an account on our
electronic platform for the purpose of making future bookings.
1.8. Newsletter
– Commercial and advertising communication provided exclusively in
electronic format to a registered user, subject to their consent, which
does not constitute a formal offer by the company.
1.9. Content
– Any graphic image, drawing, print, photo, image, sound, music, video,
audio, text, logo, button symbol, database, design, software, and any
other element displayed or accessible on the electronic platform.
1.10. Booking Creator User
– The user who directly booked the sports facility, and is obligated to
sign the acceptance act presented or sent by the "Company" before
receiving the service.

LLC, a company registered and operating in accordance with the
legislation of Georgia, registered with the National Agency of the
Public Registry under the identification number 404775383.

Conditions for Using the Electronic Platform
3.1.
These conditions for the use of the electronic platform relate to your
access to and use of the Lemans Padel electronic platform in any form,
as well as the bookings you place, regardless of the means of access or
the technologies and devices used.
3.2.
By accessing, using, or registering on the electronic platform in any
way, as well as by making a booking, you confirm that you have read and
understood the conditions and agree to be bound by the relevant
provisions.
3.3. Access to the electronic platform via internet/mobile connection is free of charge for any person.
3.4.
We cannot guarantee that our electronic platform or any of its content
will always be available and uninterrupted. We may suspend, cancel,
terminate, and/or change any part of our electronic platform without
prior notice. We shall not be held liable to you if our electronic
platform becomes unavailable for any reason, at any time, or for any
duration.
Intellectual Property Rights
4.1.
The electronic platform, as well as all electronic materials and parts
constituting its content, are protected by copyright, registered
trademarks, the company's trade name, and other intellectual/industrial
property rights. The company or the provider of such content is the
owner of all such rights or holds the relevant licenses. All such rights
are reserved.
General User Obligations
5.1. You may use the electronic platform only for personal and lawful purposes.
5.2. You may not use the electronic platform or any content:
In any way that violates any applicable national or international law or regulation;
In any way that infringes upon, restricts, or hinders another person's right to use the website;
For any commercial purpose;
If
you intentionally transmit, forward, or upload any data/material
containing viruses, so-called "Trojans," spyware, or any other malicious
software or codes intended to negatively impact computer programs and
equipment;
If
you transmit or facilitate the transmission of any unsolicited or
unauthorized advertising, promotional, or any other form of solicitation
(spam).
5.3. You also agree that:
Without
our prior written consent and outside of your personal use, you will
not copy, reproduce, frame, republish, download, print, post, repost,
broadcast, record, transmit, disclose, link, deep link, or distribute
the electronic platform or existing materials, or any computer codes and
elements constituting the electronic platform in any form;
You
will not alter or distribute any changes to the website content,
including, but not limited to, removing Lemans Padel logos and
trademarks;
You
will not damage, disrupt, or affect the security of any part of this
electronic platform, its content, or any connected network or program;
You will not place any fraudulent bookings.
5.4.
We reserve the right to immediately restrict/block any user's access to
the website and close the account of any registered user who violates
these provisions.
Our Statements and Warranties
6.1.
We will use reasonable efforts to ensure the provision of accurate,
complete, and updated content. The presence of a specific service
provider on the electronic platform at a specific time does not imply or
guarantee that the given service provider will be available at all
times. We reserve the right to stop hosting any service provider on the
electronic platform at any time.
6.2.
To the extent permitted by applicable law, Lemans Padel disclaims all
representations and warranties, express or implied, regarding the
accuracy of the content.
6.3.
In the event of errors regarding booking descriptions and/or prices, or
the absence of such data in the description of a booking on the
electronic platform, Lemans Padel reserves the right to correct these
errors and subsequently cancel or change specific bookings within the
scope of compliance with applicable law. Lemans Padel will use
reasonable efforts to ensure that the electronic platform is free from
viruses and other malicious or harmful content. However, our
recommendation is to take precautions to ensure secure access to the
electronic platform and its content, as we cannot guarantee that the use
of this platform will not cause damage to your computer or other
devices. Except as provided by applicable law, Lemans Padel shall not be
liable to any person for any loss or damage that may be incurred by
such persons due to viruses or other malicious or harmful content that
they accessed through or by means of the electronic platform.
Chapter 2 – Booking Execution, Delivery, and Refund Policy
General Provisions of Company Services
10.1.
The terms and conditions provided in this document apply to any booking
placed by you through the website www.lemanspadel.ge, regardless of the
type of device used to access the electronic platform.
10.2.
By accessing, browsing, and using our electronic platform and/or
completing/making a booking, you confirm that you have read, understood,
and agreed to the full application of these terms and conditions. If
you do not fully agree with the terms and conditions provided in this
document, do not place any booking.
10.3.
The pages where our online booking service is hosted, their content and
infrastructure, and the online booking service provided by us through
these pages and the unified portal are owned, operated, and provided by
the "Company" and are intended solely for your personal and
non-commercial use, in accordance with the rules and terms provided in
this document.
10.4.
The relationship between the company and service providers is regulated
by an independent agreement. Additionally, in addition to the policies
and rules published on the portal, the service provider may have and/or
require their own terms and conditions related to the use, access, and
enjoyment of the sports halls, courts, swimming pools, other sports
infrastructure, and equipment under their ownership or use, which may
include certain responsibilities and restrictions.
Account Registration
11.1.
To make a booking, you must open/activate an account with us. During
registration, you will be required to provide certain personal details,
including your full name, phone number, and email address. Please ensure
that all personal data is truthful, accurate, and complete. You can
update or correct your personal data at any time by accessing your
account.
11.2.
When registering an account, for the purpose of protecting your
account, you will be required to provide a password. The password you
create for your account must be unique and secure. You are responsible
for maintaining the confidentiality of your account password and for any
activity carried out through your account. Lemans Padel does not accept
liability to any person for any loss or damage that may arise if you
fail to secure your password or account.
11.3.
If you know or suspect that the security of your password or account
has been breached, or that they are being used unlawfully, please notify
Lemans Padel immediately.
Making a Booking
12.1.
All bookings are subject to our confirmation. Your booking is
considered executed only after you receive confirmation from us
electronically/via telephone. From this moment, the service is
considered rendered and completed by us.
12.2.
The information posted on the electronic platform is an invitation to
offer and is not an offer. An offer is made when you click the booking
button for your desired court. However, a booking is not considered
concluded until you receive a notification from us. We encourage you to
keep the booking confirmation sent by us until your visit is completed.
12.3.
By making a booking on our electronic platform, you agree to receive
the following at the email address or phone number provided by you:
An
email, which may be sent shortly before the time of your visit, to
provide information about your destination and certain offers;
An email after your visit, to evaluate your experience with the service provider and the service received;
An email that we may send immediately after your visit, to fill out our customer review form.
12.4.
In order to properly complete and secure your visit booking with the
service provider, you must use your correct email address. We are not
responsible and have no obligation to verify any incorrect or misspelled
email address or incorrect phone or credit card number.
12.5.
Due to constant updates to services, rates, and availability, we
recommend that you take screenshots during the booking process to
support your position, should the need arise.
Prices and Service Provider Offers
13.1.
Unless otherwise indicated on our electronic platform, the prices
offered by service providers on our electronic platform include VAT and
all other taxes, including the commission set for the use of the
company's services. Payment service commissions (if any) may be added to
the final price; accordingly, the amount payable when you pay for the
booking may consist of the following elements: Booking Fee + Payment
Service Commission (if any).
13.2.
Through the electronic platform, it is also possible to purchase
subscriptions for the purpose of using various services offered by
service providers. Please note that subscription prices are given per
person or group and grant the user the right to use the relevant service
within the terms and conditions specified therein.
Payment Procedure and Payment Methods
14.1.
The user is obliged to pay the service fee at the time of booking using
the online payment method available on the electronic platform;
otherwise, the user's booking will be cancelled, and the service
provider is released from the obligation to provide the service.
14.2.
At the time of drafting these terms and conditions, Lemans Padel offers
payment provided by "Bank of Georgia," which is a registered payment
service provider.
Cancellation and Modification of Bookings
15.1.
Our service is considered completed and rendered, as well as fully
accepted by you, from the moment you receive confirmation of the booking
execution. Therefore, you do not have the right to cancel/modify or
waive your booking, except for the conditions listed below.
15.2. The user can electronically change the booking time through their account. Booking cancellation and refunds are not provided.
15.3.
Please note that in the event of a booking cancellation by the user
less than 24 (twenty-four) hours in advance, the paid amount is not
refundable; however, the user may change the booking time within the
available slots of the same price category remaining until the end of
the working day. In the absence of available spots within the specified
period, the booking is considered cancelled or may be moved to the
following days.
15.4.
In the case of a booking cancelled or postponed due to deteriorating
weather, the amount paid by the user is not refunded; however, such a
booking may be compensated by moving the booking, in whole or in part,
to other available times at the same sports facility.
